June 29, 2023 – M&H Wins Reversal And Vacatur Of Default In Successful “Law Office Failure” Appeal

In this action to recover damages for personal injuries, the Appellate Division, First Department, in accordance with M&H’s arguments on appeal, reversed the lower court’s order, vacated the plaintiff’s default and remanded the matter for a damages inquest, finding that the plaintiff should not be penalized for the law office failure of her counsel.
