In accordance with M&H’s arguments on appeal, the Appellate Division, Second Department, reversed the lower court’s award of summary judgment to the defendant and reinstated the plaintiff’s complaint, finding that the defendant had failed to establish that it was the alter ego of the plaintiff’s employer for the purposes of raising the Workers’ Compensation bar.
