August 9, 2023 – M&H Wins Reversal and Dismissal of Complaint in Queens County Medical Malpractice Action

In this action to recover damages for medical malpractice, the Appellate Division, Second Judicial Department, in accordance with M&H’s arguments on appeal, reversed the lower court’s order and dismissed the complaint against a physician who had prescribed Ambien to a patient who subsequently committed suicide, determining as a matter of law that any alleged departure from the accepted standard of medical care was not a proximate cause of the suicide as a matter of law.
