August 21, 2019 – M&H Wins Reversal Of Summary Judgment And Reinstatement Of Client’s Legal Malpractice Action Against Bankruptcy Counsel

In this action to recover damages for legal malpractice, the Appellate Division, Second Department reversed an award of summary judgment in favor of the Defendant, holding, in accordance with M&H’s arguments on appeal, that Plaintiff’s legal malpractice cause of action was not subject to dismissal on the grounds of collateral estoppel and in pari delicto.
