November 9, 2023 – M&H Wins Reversal and Reinstatement of Negligence And Negligent Misrepresentation Claims Against Financial Advisor

In this action to recover damages for negligence and negligent misrepresentation, the Appellate Division, First Department, in accordance with M&H’s arguments on appeal, reinstated the plaintiff’s claims against her financial advisor, determining that the defendants owed her a duty of care when they failed to advise her that her beneficiary status under a life insurance policy was subject to challenge.
