In this appeal stemming from an accident that occurred in the hallway of a Brooklyn community-housing facility, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, reversed the lower court’s award of summary judgment to the defendants, holding that the defendants’ prima facie showing was deficient insofar as they had asserted “open and obvious” and “independent contractor” defenses.
