November 9, 2023 – M&H Wins Labor Law 240(1) Appeal Stemming From Bronx County Construction-Site Accident

In this action to recover damages based upon the violation of Labor Law 240(1), the Appellate Division, First Department, in accordance with M&H’s arguments on appeal, determined that the placement of plywood over a bathtub created an elevated work platform under the statute, thereby entitling the plaintiff to summary judgment.
