December 27, 2023 – M&H Wins Reversal And $500,000 Additur To $500,000 Damage Award For Past Pain and Suffering

In this post-trial appeal stemming from a claim of nursing-home negligence, wherein the plaintiff’s decedent fell out of his wheelchair and required life-changing hip surgery, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, added $500,000 to the $500,000 damage award which had been set by the trial court, holding that the amount set by the trial court deviated materially from what has been considered reasonable compensation in analogous matters.
