September 26, 2018 – M&H Wins Reversal And Reinstatement Of Plaintiff’s Case Against Municipal Defendant

In this action to recover damages for personal injuries, the Appellate Division, Second Judicial Department, in accordance with M&H’s arguments on appeal, reversed a prior award of summary judgment in favor of the municipal defendant and reinstated Plaintiff’s claim, finding that the lower court had erred in denying Plaintiff’s request to amend the Notice of Claim.
