September 13, 2023 – M&H Wins Reversal And Award Of Summary Judgment On Labor Law 240 Cause of Action In Long Island Construction Accident

In this action seeking damages for injuries sustained in a Long Island construction accident, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, vacated the lower court’s order and awarded summary judgment to Plaintiff on his Labor Law 240 claim, holding that Plaintiff’s injury, sustained while preventing himself from falling from a scaffold, was an elevation-related risk which fell within the ambit of the Labor Law protections.
