In these four commercial mortgage foreclosure actions, based upon four, separate notes/mortgages, the Appellate Division, Second Judicial Department, in accordance with M&H’s arguments, reversed the lower court’s prior award of summary judgment in favor of the promissory noteholders and vacated the four Judgments of Foreclosure and Sale, finding that the noteholders’ evidence was lacking, and the mortgager’s statute of limitations defense should be reinstated.
