November 9, 2023 – M&H Wins Reversal Of Lower Court’s Dismissal of Labor Law 240(1) Claim And Wins Summary Judgment on Liability for Plaintiff Injured in Manhattan Construction Site Accident

In this action to recover damages based upon the violation of Labor Law 240(1), the Appellate Division, First Department, in accordance with M&H’s arguments on appeal, vacated the lower court’s dismissal and awarded partial summary judgment to the plaintiff, who was injured when a commercial vacuum fell into the manhole where he was working.
