November 8, 2023 – M&H Wins Reversal and Summary Judgment For Plaintiff On Labor Law 241(6) Claim

In this action seeking damages for injuries sustained in a construction-site accident, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, reversed the lower court and awarded summary judgment to the plaintiff, finding that the defendants violated Labor Law 241(6) as a matter of law by placing a raised or bowed Masonite board over the floor of a passageway at the worksite.
