May 7, 2019 – M&H Wins Reversal Of Summary Judgment By First Department In Case Involving Construction – Site Accident

In an action to recover damages for personal injury stemming from a construction-site accident, the Appellate Division, First Judicial Department, in accordance with M&H’s arguments on appeal, unanimously reversed the lower court and held that Plaintiff’s Labor Law and common-law negligence claims should be reinstated against the owner of the Manhattan construction site and the general contractor.
