In this matrimonial action, the Appellate Division, Second Judicial Department, in accordance with M&H’s arguments on appeal, affirmed the award of sole physical and legal custody of the child to the father upon finding that, notwithstanding the recommendation of the independent forensic evaluator, it would be in the child’s best interests under the totality of the circumstances.
