March 8, 2018 – M&H Wins Subrogation Appeal On Behalf Of Nursing Home Insurer

In this action to recover damages for construction negligence, the Appellate Division, First Judicial Department, in accordance with M&H’s arguments on appeal, affirmed the denial of the defendant’s motion to amend its answer to include the affirmative defense of statute of limitations, and, upon such amendment, to dismiss the complaint.
