In this federal post-trial appeal stemming from a Brooklyn tractor-trailer accident, the Second Circuit, in accordance with M&H’s arguments on appeal, affirmed the District Court’s denial of the plaintiff’s motion to set aside the jury verdict, finding that the defendant-driver’s testimony presented a credibility issue for the jury and thus was sufficient to support the jury verdict.
