In this action to recover damages for injuries sustained in a Queens County motor vehicle accident, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, denied Defendant’s summary judgment motion, finding that it had failed to establish that the plaintiff’s negligence was the sole proximate cause of the accident.
