June 15, 2022 – M&H Wins Reversal And Reinstatement Of Medical Malpractice Complaint Against Richmond County Hospital In Case Involving Failure To Diagnose Cervical Cancer

In accordance with M&H’s arguments on appeal, the Appellate Division, Second Department reversed the lower court’s award of summary judgment to the defendant-hospital and reinstated the complaint, finding triable issues of facts concerning the hospital’s vicarious liability for its employees under the doctrine of respondeat superior.
