In this personal injury action, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, affirmed the denial of Defendant’s motion to compel discovery/impose sanctions, finding that Defendant’s Affirmation of Good Faith did not evince a diligent effort to resolve the discovery dispute prior to filing the motion.
