January 12, 2021, M&H Overturns $27 Million Contractual Indemnification Claim By Manhattan Shopping Mall Owner Against Security-Services Company

In this action to recover damages for catastrophic personal injuries sustained at a Manhattan shopping mall, the Appellate Division, First Department, in accordance with M&H’s arguments on appeal, overturned the lower court’s determination requiring M&H’s client, a security-services company, to provide full contractual indemnification to the mall owner, including for the owner’s own negligence.
