January 10, 2023 – M&H Wins Appeal Against NYC, MTA And Contractors Stemming From Catastrophic Manhattan Motorcycle Accident In First Avenue Construction Zone

The Appellate Division, First Judicial Department, in accordance with M&H’s arguments on appeal, affirmed the denial of summary judgment as to all defendants involved in the First Avenue Bike Lane and Bus Bulb Projects, holding that NYC is not entitled to immunity and there are triable issues of fact as to whether the two concurrent and ongoing construction projects and related activities of the defendants were a proximate cause of the accident.
