December 13, 2017 – M&H Wins Reversal And New Trial Based Upon Erroneous Trial Ruling Regarding The Authentication Of Photographic Evidence

In this personal injury action, the Appellate Division, Second Judicial Department reversed the judgment appealed from and determined, in accordance with M & H’s arguments on appeal, that a new trial was required because the photographs of the uneven sidewalk that caused plaintiff’s injuries should not have been excluded at trial.
