April 4, 2018 – M&H Wins Reversal Of Judgment Entered After A Non – Jury Trial In Breach Of Contract Action Against Seller Of Commercial Real Property

In this action to recover damages for breach of a $30 million contract for the sale of commercial real property located in Williamsburg Brooklyn, the Appellate Division, Second Judicial Department, in accordance with M&H’s arguments on appeal, reversed the trial court’s determination, made after a non-jury trial, and held that the contract, which was signed by both parties and embodied all the essential terms of the agreement, is valid and enforceable. Additionally, the appellate court rejected both the seller’s contention that M&H’s corporate client had breached the contract, and a subsequent purchaser’s contention that it was a good faith purchaser for value.
