In this action to recover damages for medical malpractice, the Appellate Division, Second Department, in accordance with M&H’s arguments on appeal, reversed the lower court’s order denying Plaintiff’s motion to vacate a default in opposing summary judgment, stressing the strong public policy in this State in favor of deciding cases on the merits.
