June 16, 2022 – M&H Prevails on Motion to Set-Aside 75 Years-To-Life Sentence, And To Resentence Defendant In 1991 Attempted Murder In the First Degree Case

By Decision & Order, dated June 16, 2022, the Supreme Court, Kings County, on motion filed by M&H, pursuant to CPLR 440.20, to set-aside the seventy-five year to life aggregate sentence on 3 convictions for attempted murder in the first degree of three police officers, on the ground that the sentences imposed in 1991 were grossly disproportionate to the crimes for which the sentences were imposed, granted the motion and resentenced the defendant to three concurrent sentences of twenty-five years to life, making him immediately eligible for parole.
