In this personal injury action, the Appellate Division, Second Department, in accordance with M&H’s arguments, reversed the lower court’s order and reinstated Plaintiff’s claim, rejecting Defendants’ attempt to win a CPLR 3211 (a)(1) dismissal based upon a party affidavit.
