In an action to recover damages for wrongful death stemming from a construction-site accident, the Appellate Division, First Judicial Department, in accordance with M&H’s arguments on appeal, unanimously reversed the lower court and dismissed all Labor Law claims based upon the Homeowner’s Exemption.
